Dr Daniel Ubani should face justice in this country

THE decision taken by the european Court of human Rights to block the extradition of Dr Daniel Ubani back to Great Britain to face trial is a grave miscarriage of justice.

Dr Ubani ?was responsible for the death of 70-year-old David Gray who died after the locum doctor administered him 10 times the normal dose of diamorphine. The British coroner who investigated the case said that Mr Gray’s death amounted to “gross negligence and manslaughter” and slammed Ubani as “incompetent".

It is scandalous that such condemnation has been ignored. Ubani has never had to face justice in this country even though he caused the death of a British citizen while working on British soil.

Instead, as a German doctor, he has been dealt with by the German authorities who have let him off scandalously lightly. They charged him with medical negligence, but he did not have to attend court and did not even contest the order. he is even free to continue working as a plastic surgeon in Germany. 

This course of action has failed to bring about justice for Mr Gray. Ubani should have been subject to legal examination in this country and faced with an appropriate punishment. Furthermore the fact that a doctor with such a poor record is currently free to treat and operate on patients is deeply worrying.

Questions for claimants

It is still embarrassingly easy for benefit cheats to commit fraud against the system as the case of Jem Bakalej demonstrates. Bakalej claimed almost £50,000 in benefits over an 11 year period by lying about the death of his daughter Grace. 

The court was told that Bakalej had failed to notify HMRC of a change in his circumstances after Grace’s death in 2001, but all too often the Government makes it easy for benefit cheats to get away with scams such as this one. 

It would only have taken some cursory enquiries to establish that Bakalej’s daughter had died a little more than a month after she was born yet for 11 years those questions were never asked. That the Government does not thoroughly check the information provided by benefit claimants only encourages fraudsters.
